Welcome to the experience of not being alone in the
dreadful business of resisting unreasonable activity by
a South African bank!

In 2017/8, the movement achieved a major victory. Banks were required to
provide a reserve price when they sell your house. We thought we had
achieved our objective, but although better, we are finding that banks are
still selling people’s houses for 50-70% of their value on many occasions
(and then coming after you for the balance on the bond!).

Further there are still many situations where banks are selling when it is
definitely NOT a last resort: where the person now has a new job and can
pay; when the person wants to rent the place out; when it can be subdivided,
and many others.

To help you we need some initial information, we need to know where you are
from (what city your are closest to), what stage you are at (how close you
are to being evicted), you cell number, what Bank, whether you want an
appointment to get advice, or whether your property has already been sold
and you want to be part of our class action.

Unfortunately, we can’t see people or draft documents entirely for free
(“pro bono”) as we have to pay salaries for our staff, office costs, school
fees and all the rest of the burdens of modern life. We don’t live
extravagant lives and we charge a lot less than most other lawyers
especially ones with our experience in this particular issue (very rare).
We also let you pay up gradually if that would be helpful.

We often see banks act in a manner we consider irresponsible. You cannot
trust them to do what most people would see “the right thing”.
Our banks are still incredibly under-regulated when it comes to their
willingness to sell a persons house when it is not a last resort.

We believe banks (especially certain ones) try and sell houses when it is
far from a last resort and that often the price is far less than it could
be. Even now after we have changed the law, we see reserve prices and
therefore sales at mostly 50 to 70 per cent of value. Being in the position
that the banks might sell your house half price is a big risk. Unfortunately,
if your house is worth, say, a million rand then that means that you could
lose R250,000 – R500,000 and lose a home you may be very attached to.

There are many things that we may be able to do for you including negotiate
a reasonable settlement with your bank; hold off till you can sell; draft
papers defending you and/or appear for you in court so that you can start
your bond again and keep your house. There are people who have at least been
able to continue to stay in their house for an extra year or even many years
as a result of the help of Adv Shaw.

bank has been wrong in your case and how to fight them which means you
